This morning, The Big Metal Shed on the Hill runs this story from yesterday’s County Commission Work Session. David Buuck, the deputy Knox County Law Director says that a violation of the open meetings law aka sunshine law is a moot point.

Oh, quite the contrary!

I seem to recall that the Knox County Commission is under a permanent injunction because of the 2007 open meetings law violation and using an intermediary is prohibited as well. The Knox County Audit Committee is a committee of the County Commission. The Auditor is an employee of the Commission. The argument can be made that the Audit Chairman was the intermediary for the three County Commissioners that serve on the audit committee that met and subsequently determined before and on July 9, 2013 to recommend to the other 8 Commissioners (because the other 3 voted in Committee and there are 11 Commissioners) to terminate Walls. Of the 11 Commissioners only a majority of 6 require termination of Walls. The audit committee had already determined 50% of the vote to terminate Walls.

Now is the time for Chancellor Fansler to intervene and determine what happened.
